Why should I draft a will?

  1. In a will you state who you want to receive your property. A well written will prevent any family fighting over what bills should be paid and who should get what property items.
  2. It allows you to name your own executor and to have the posting of a bond waived for your executor. If you die without a will whoever applies to be your executor or an “administrator” will have to post a bond of two times the amount of your estate. That is expensive and makes your heirs have to deal with issues that emotionally they may not be ready to deal with.
  3. If you do not have a will anyone can apply to administer your estate including your ex-spouse, a credit card company, any one you owe a debt to, or even your neighbor down the street. The only restriction on who may apply to administer your estate is that they can not be a convicted felon or convicted of a crime involving fraud or dishonesty.
  4. If you have minor children you can appoint who will look after your children and who will handle their financial affairs. If you die without a will the State of Ohio will make those decisions for you.

It is very important for everyone to have a will. The cost of drafting a will is minor compared to the cost your family will have to incur by not having one.
